Privacy Policy nearby.pl
Version 2.0 of 13.10.2026. If the Polish and English versions differ, the Polish version prevails.
1. Who is the controller of your data
Ad Libertatem sp. z o.o., ul. Solec 81B/73A, 00-382 Warsaw, Poland, KRS 0000355081, NIP (tax ID) 5213564019, REGON 142408550, operating the Nearby brand. This company employs the team that runs the nearby.pl website and the Nearby social media profiles, answers enquiries and serves tenants.
Contact on data matters: rental@littlehome.pl or a letter to the company address marked “Personal data”. You can raise any matter concerning your data at this address, also when your tenancy agreement was signed by a different company.
2. Who is responsible for your tenancy agreement data
Your tenancy agreement names the company that signs it. There are three possibilities:
- Ad Libertatem sp. z o.o. signs the agreement. That company is the only controller of the agreement data.
- Little Home Rental sp. z o.o., ul. Solec 81B/73A, 00-382 Warsaw, KRS 0000774926, NIP 7010911072, signs the agreement. The agreement data is then processed jointly by Little Home Rental, the party to the agreement, and Ad Libertatem, which prepares the agreement and serves the tenancy. Both companies are joint controllers (Art. 26 GDPR). They have agreed that Ad Libertatem runs the service, provides information and handles your requests on behalf of both companies, and Little Home Rental is responsible for the accounting documents of its agreement. You may exercise your rights against either of them.
- Ad Libertatem signs the agreement on behalf of the owner of the flat. The owner is the controller of the data needed for that agreement, and Ad Libertatem processes it on the owner's behalf as the property manager (Art. 28 GDPR).
Your room enquiry, contact before the agreement, the nearby.pl website and the Nearby profiles are always data for which Ad Libertatem is responsible.
3. Why we process your data and on what legal basis
- Answering your enquiry about a room (the “Send Enquiry” form, e-mail, phone, a message on a Nearby profile): name, e-mail address, phone number, the content of your enquiry and the room you ask about. We contact you by e-mail or phone about that enquiry, present available rooms and arrange a viewing. Legal basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR).
- Concluding and performing the tenancy agreement and serving you during the tenancy (repair requests, settlements, deposit): contract data, identity document data to the extent required for the agreement, contact details, payment and request history. Legal basis: performance of a contract (Art. 6(1)(b) GDPR); we keep accounting and tax documents because the law requires it (Art. 6(1)(c) GDPR).
- Establishing and defending legal claims and accountability: our legitimate interest (Art. 6(1)(f) GDPR).
- Marketing offers by e-mail or phone beyond your enquiry: only if you give separate consent (Art. 6(1)(a) GDPR and Art. 398 of the Polish Electronic Communications Law).
- Cookies and tags on the website: see section 4.
- Nearby social media profiles: see section 5.
We do not make decisions about you based solely on automated processing (Art. 22 GDPR). A person decides on any tenancy offer.
4. Cookies and tags
nearby.pl uses three groups:
- Necessary (session, booking cart, language choice, record of your banner choice). They run without consent because the site cannot work without them (Art. 399(3) of the Polish Electronic Communications Law).
- Analytics: Google Analytics 4, loaded through Google Tag Manager. They run only after your consent.
- Marketing: Meta Pixel (Facebook, Instagram) and the Google Ads conversion tag. They measure ad performance and let us show ads to people who visited the site. They run only after your consent.
Google Tag Manager loads only after consent. We do not send the data you type into the enquiry form to Google or Meta.
Legal basis: your consent (Art. 399 of the Polish Electronic Communications Law and Art. 6(1)(a) GDPR) for groups 2 and 3. You can change or withdraw your consent at any time with the “Cookie settings” link in the site footer. We remember your choice for 12 months.
5. Nearby profiles on Instagram and TikTok
- Ad Libertatem is the controller of the data of people who follow the Nearby profiles, comment, react to posts or send us messages. We see your profile name, public information from it, the content of comments and messages, and reactions. We publish posts, and read comments, messages and statistics, also through the Zernio tool (section 6.5).
- Purposes and legal bases: replying to a comment or message and running the profile, that is informing about rooms and life in Nearby flats (our legitimate interest, Art. 6(1)(f) GDPR). When you ask about a room in a message, we then proceed as with an enquiry under section 3.1. We use profile statistics to see which posts reach their audience (our legitimate interest, Art. 6(1)(f) GDPR).
- Profile statistics: Instagram provides us with aggregated statistics (for example the number of views and the age range of the audience) that do not identify you. For Instagram statistics, Meta Platforms Ireland Limited and we are joint controllers (Art. 26 GDPR); Meta has taken primary responsibility for that data and for handling your rights in that respect (arrangement: facebook.com/legal/terms/page_controller_addendum). The same applies to TikTok: for collecting data on how users interact with the Nearby profile and turning it into statistics, TikTok Technology Limited (Ireland) and we are joint controllers (Art. 26 GDPR). TikTok is responsible for enabling you to exercise your rights in that respect (arrangement: tiktok.com/legal/page/global/tiktok-analytics-joint-controller-addendum/en), and we receive only aggregated statistics. If you write to us about it, we will forward your request to TikTok within 7 days.
- Meta and TikTok also process your data for their own purposes and under their own rules, set out in their privacy policies. You can adjust there what the platform collects about you.
- Comments stay on the profile until you or we delete them. We keep messages as enquiries under section 8.1.
6. Who receives your data
- Odoo S.A. (Belgium): the nearby.pl website, booking and tenant service system.
- Google (Google Ireland Limited): company e-mail and documents (Google Workspace) and, with your consent, Google Analytics, Google Tag Manager and Google Ads.
- Meta Platforms Ireland Limited: with your consent, Meta Pixel, and Instagram, where we run the Nearby profile. For the pixel, Meta and we are jointly responsible for collecting and transmitting browser data; Meta then processes it as a separate controller.
- TikTok Technology Limited (Ireland): TikTok, where we run the Nearby profile; for profile statistics also as a joint controller (section 5.3).
- ZERNIO SOFTWARE SL (Spain): the tool through which we publish posts on the Nearby profiles and read comments, messages and statistics. It processes that data on our behalf and on our instructions (Art. 28 GDPR).
- Little Home Rental sp. z o.o.: when it is the party to your tenancy agreement, to the extent of that agreement (section 2).
- Companies carrying out repairs and cleaning in the flats, including companies of our group: to the extent needed to fix a fault or perform the service.
- The owner of the flat in which you rent a room: to the extent needed for the agreement and settlements.
- Our accounting office and bank: for settlements.
- Public authorities: only where the law requires it.
7. Transfers outside the European Economic Area
Google and Meta may transfer data to the United States. Such transfers rely on the European Commission decision of 10 July 2023 on the EU-US Data Privacy Framework (Art. 45 GDPR) or, where it does not apply, on standard contractual clauses (Art. 46(2)(c) GDPR). Zernio uses providers in the United Kingdom and the United States; such transfers rely on a European Commission adequacy decision (Art. 45 GDPR) or on standard contractual clauses (Art. 46(2)(c) GDPR). TikTok also processes its users' data outside the EEA under the rules set out in its privacy policy. Write to rental@littlehome.pl to receive a copy of the safeguards we apply.
8. How long we keep your data
- An enquiry, including a message on a profile, that did not lead to an agreement: 12 months from our last contact.
- Tenancy agreement data: for the term of the agreement and then until claims under it expire (usually 3 to 6 years).
- Accounting documents: 5 years from the end of the year in which the tax payment deadline passed.
- Cookie data: for the period shown for each tool in the banner.
9. Your rights
You have the right to access your data, rectify it, have it erased, restrict processing, data portability, withdraw consent at any time and object to processing based on legitimate interest. We always honour an objection to direct marketing, without you giving a reason. Write to rental@littlehome.pl; we reply within one month, also on behalf of Little Home Rental where it is the party to your agreement. You may also lodge a complaint with the President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warsaw, Poland, uodo.gov.pl.
Providing data is voluntary. Without an e-mail address or phone number we cannot answer your enquiry; without contract data we cannot sign a tenancy agreement.
